Medicaid Planning focuses on restructuring assets to meet federal and state eligibility criteria so that your loved one can get the medical care they need and deserve.
There are five basic Medicaid eligibility criteria: three general criteria and two “means testing” criteria:
- The person receiving benefits must be a resident of Texas and a citizen of the United States.
- The person receiving benefits must be at least 65 years old and have a medical necessity for long term care.
- The person receiving benefits must be in a skilled nursing facility for thirty days prior to filing the application.
- The person receiving benefits must not have more than $2,742.00 in monthly gross income. This amount reflects 2023 law and may increase annually.
- The person receiving benefits must not have more than $2,000.00 in countable resources.
However – for each of the eligibility criteria there are exceptions and non-obvious ways of meeting the criteria. We have helped hundreds of families develop plans to comply with the regulations for eligibility while also preserving as much of the estate as possible.
A well-constructed plan can enable families to keep their home or farm. And most importantly, a Medicaid recipient can still pass an inheritance to their children or grandchildren.
